ONLINE GALLERY TERMS AND CONDITIONS<\/p>\n

  1. KEY DEFINITIONS<\/li>\n<\/ol>\n

    Buyer means an individual or legal entity intending to purchase goods on the Seller\u2019s Online Gallery website.<\/p>\n

    The Buyer shall provide the Seller with ACCURATE personal information (surname, first name, email address, and telephone number). This information is provided when placing an Order.<\/p>\n

    Seller means an organisation that sells goods through the Online Gallery located at www.kvartiras.com.<\/p>\n

    Online Gallery means a website where any Buyer may view the Goods offered, their descriptions and prices, select particular Goods, choose a payment and delivery method, and place an Order.<\/p>\n

    Goods means an item offered for sale in the Online Gallery by being displayed in the relevant section of the Online Gallery.<\/p>\n

    Order means a request placed by the Buyer for the purchase and delivery, to the specified address, of Goods selected in the Online Gallery.<\/p>\n

    SKU means the designation assigned to the Goods by the Manufacturer.<\/p>\n

    1. GENERAL PROVISIONS<\/li>\n<\/ol>\n

      These terms and conditions for the sale of goods in the Online Gallery (hereinafter, the \u201cTerms\u201d) govern the purchase of Goods through the Online Gallery by individuals or legal entities, hereinafter referred to as the \u201cBuyer\u201d; the Seller and the Buyer are hereinafter collectively referred to as the \u201cParties\u201d and individually as a \u201cParty.\u201d<\/p>\n

      Each Party warrants to the other Party that it possesses the requisite legal capacity and competence, as well as all rights and authority necessary and sufficient to enter into and perform the sale and purchase agreement.<\/p>\n

      By ordering Goods through the Online Gallery, the Buyer agrees to these Terms.<\/p>\n

      The Seller reserves the right to amend these Terms; therefore, the Buyer undertakes to regularly review any amendments to the Terms posted on the Online Gallery page.<\/p>\n

      The Buyer agrees to these Terms by checking the relevant box when placing an Order.<\/p>\n

      1. PLACING AND FULFILLING AN ORDER<\/li>\n<\/ol>\n

        When placing an Order, the Buyer confirms that they have read the user agreement and provides the Seller with the ACCURATE information required to process the Order.<\/p>\n

        The Seller prepares and dispatches the ordered Goods after the Order has been placed.<\/p>\n

        If the Buyer has any questions concerning the properties or characteristics of the Goods, the Buyer must contact the Seller, using the Seller\u2019s contact details published on the Online Gallery website, before placing an Order.<\/p>\n

        If the delivery address changes, the Buyer must notify the Seller of the change verbally by telephone at +7 (925) 113-40-17 or by email at info@kvartiras.com. No claims will be accepted if this provision is not complied with.<\/p>\n

        \u00a0 \u00a04. PAYMENT FOR GOODS<\/p>\n

        Prices in the Online Gallery are quoted per item.<\/p>\n

        Only Goods confirmed as being in stock at the time of ordering may be ordered.<\/p>\n

        The Buyer shall pay for the Goods in the currency in which their price was quoted on the Online Gallery website when the Order was placed.<\/p>\n

        The Buyer must personally be the payer. Payments from third parties are not accepted. Payment may be made only by one of the methods offered on the Online Gallery website when placing an Order. No other payment methods are available.<\/p>\n

        The sale and purchase agreement shall be deemed concluded when the Buyer pays for the ordered Goods.<\/p>\n

        \u00a0 \u00a05. DELIVERY<\/p>\n

        The Seller will make every effort to meet the delivery date and time agreed when the Order was placed; however, delivery may be delayed due to unforeseen circumstances beyond the Seller\u2019s control.<\/p>\n

        The risk of accidental loss of or damage to the Goods passes to the Buyer when the Goods are handed over to them and the Buyer signs the documents confirming delivery of the Order.<\/p>\n

        To prevent fraud, the Buyer must present proof of identity upon receipt of a prepaid Order.<\/p>\n

        \u00a0 \u00a06. RETURNS<\/p>\n

        Goods may be exchanged or returned in accordance with applicable law.<\/p>\n

        The possibility of exchanging or returning Goods must be agreed by calling the telephone number published on the Online Gallery website.<\/p>\n

        \u00a0 \u00a07. WARRANTIES AND LIABILITY<\/p>\n

        The Seller shall not be liable for any damage caused to the Buyer as a result of the improper use of Goods purchased from the Online Gallery.<\/p>\n

        The Seller shall not be liable for losses incurred by the Buyer as a result of:<\/p>\n

        incorrectly provided personal data,<\/p>\n

        unlawful acts by third parties.<\/p>\n

        The Buyer bears full responsibility for the accuracy of the information provided when placing an order in the Online Gallery.<\/p>\n

        The Parties shall be released from liability for the complete or partial failure to perform their obligations if such failure results from force majeure circumstances arising after the Terms came into effect due to extraordinary events that the Parties could neither foresee nor prevent by reasonable measures.<\/p>\n

        In other cases of non-performance or improper performance of their obligations not provided for in the provisions of the Terms, the Parties shall be liable in accordance with applicable law.<\/p>\n

        \u00a0 \u00a08. PRIVACY AND PROTECTION OF PERSONAL INFORMATION<\/p>\n

        Information provided by the Buyer.<\/p>\n

        When placing an order in the Online Gallery, the Buyer provides the following information: surname, first name, email address, telephone number, and delivery address. The Seller may unilaterally amend the list of data required to process an Order.<\/p>\n

        The Seller uses the information received from the Buyer:<\/p>\n

        to fulfil its obligations to the Buyer;<\/p>\n

        to evaluate and analyse the performance of the Online Gallery.<\/p>\n

        The Seller undertakes not to disclose information received from the Buyer. The Seller\u2019s provision of information to agents and third parties acting under an agreement with the Seller for the purpose of fulfilling obligations to the Buyer shall not constitute a breach. The disclosure of information in accordance with reasonable legal requirements shall not constitute a breach of obligations.<\/p>\n

        The Seller may use cookie technology. Cookies are service data sent by a web server to a user\u2019s computer for storage in the browser. This information is used to store user-specific data employed by the web server to ensure the proper operation of the Online Store. Cookies contain no confidential information and are not transferred to third parties.<\/p>\n

        The Seller receives information about the IP address of each visitor to the Online Gallery. This information is not used to identify the visitor.<\/p>\n

        The Seller shall not be liable for information made publicly available by the Buyer on the Website, for example, in product reviews.<\/p>\n

        \u00a0 \u00a09. MISCELLANEOUS<\/p>\n

        The relationship between the Buyer and the Seller shall be governed by applicable law.<\/p>\n

        The Buyer warrants that all provisions of these Terms are clear to them and that they accept them in full.<\/p>\n

        If the Buyer wishes to submit positive feedback or a complaint, they must contact the Seller at the email address specified on the Online Gallery website.<\/p>\n

        The Parties shall endeavour to resolve all disputes through negotiation. If no agreement can be reached, the dispute shall be referred to a court in accordance with applicable law.<\/p>\n

        The invalidity of, or failure by either Party to comply with, any provision of these Terms shall not affect the validity of the remaining provisions of the Terms.<\/p>\n

        If the Buyer disagrees with even one provision of these Terms, they are not entitled to use the Online Gallery.<\/p>\n
